Use of Services and Forensic Disclaimer
Services provided by this practice are primarily clinical in nature. Evaluations and treatment are conducted for the purpose of diagnosis, treatment planning, and ongoing clinical care. As such, clinical evaluation fees listed on this website do not apply to cases involving actual or anticipated legal use.
Scope of Services
This practice is not structured as a forensic service provider. While forensic services may be considered in limited circumstances, such services are not the primary focus of the practice and are accepted only on a case-by-case basis.
Example of clinical services not intended for legal or forensic purposes include, but are not limited to:
- Court proceedings (civil or criminal)
- Disability determinations
- Worker’s compensation claims
- Personal injury or malpractice cases
- Fitness-for-duty or employment-related evaluations
- Immigration or legal status proceedings
Forensic Services
If a service is requested for, anticipated to be used in, or later becomes involved in legal proceedings, it will be considered a forensic service. Forensic services require advance discussion and explicit agreement prior to scheduling. Different procedures, documentation standards, and fee structures will apply.
In circumstances where forensic services are accepted, a separate Forensic Engagement Agreement is required. Fees for forensic services typically begin at $450 per hour and differ from the clinical fee schedule. Forensic services may be declined at the discretion of the clinician.
If Legal Involvement Occurs After Clinical Services have been initiated
- Patients and referring parties are expected to inform the clinician if legal involvement arises or becomes anticipated at any point during clinical services. Failure to do so may result in modification of services, transition to a forensic agreement, or limitation of the clinician’s involvement.
- If a clinical service later becomes involved in legal proceedings, it will be considered a forensic matter. Clinical services are not designed for legal use and cannot be converted into forensic services after the fact without prior discussion and a separate agreement.
- The clinician does not participate in legal processes on a voluntary basis. Requests for testimony, consultation, or additional records review must be formally arranged in advance under a separate forensic agreement.
- In the event of a subpoena or court order, the clinician will respond in accordance with applicable laws and professional obligations. Any such involvement will be subject to separate policies and fees under the forensic fee schedule.
Disclosure Responsibility
Patients, attorneys, and referring parties are responsible for disclosing any current or anticipated legal involvement prior to scheduling services. This includes situations in which evaluation results may be used in legal, administrative, or employment-related contexts, even if legal proceedings have not yet been initiated. Failure to disclose such involvement in advance may result in modification of services, transition to a forensic agreement, or referral to another provider.
